1. Subscription
By registering on our servers, you subscribe to membership with the Company. We are not a marriage agency and do not provide marriage agency services, mail order bride services, or matchmaking services. We facilitate members in finding partners by providing information and photos shared by other members, in accordance with our Privacy Statement.
Members agree to provide only genuine information and commit to not giving any false information about their present or past. Convicted sex offenders are prohibited from using our services.
By signing up, you become a “free member” with no obligations from the Company. Periodically, the Company may provide a promo code granting temporary access to “premium membership” services. Access to these services can be halted or cancelled at any time without warning or explanation, and without any right to compensation from the Company.
If you choose to upgrade your membership to a fee-based "Premium Membership", by pressing the “Buy” button (or similar), you confirm your intent to purchase the selected Premium Membership. Subscriptions are available at the prices, for the periods, and by the payment methods specified on the upgrade membership page. Prices are stated in the currency shown on the upgrade membership page and include all applicable taxes unless otherwise stated. Our contractual relationship for that Premium Membership will be confirmed when Pinaheart sends you an email confirmation of your order.
The nature of the services we provide may evolve over time and may not necessarily be preferred by all members. The Company aims to provide the best possible services for a set price and intends to improve these services, without commitment to a specific methodology or functionality.
Your membership will automatically renew. You can opt out of auto-renewal at any time. If you have not opted out, the subscription will be auto-renewed for the periods stated. You can cancel auto-renewal at any time on the Billing page in the Settings menu of the website or app.
In the event of recurring billing for subscription fees applicable to your chosen plan, you hereby authorize the Company to charge these fees on a recurring basis.
We may change the price of a subscription at any time. Auto-renewals of existing subscriptions will continue at the old price.
In case of suspicious payment activity, the Company reserves the right to temporarily or permanently halt payments via your credit card or other electronic payment methods.
Right to Cancel: If you change your mind about subscribing for a premium membership, you have the right to cancel your subscription, without reason, within 14 days from the date we sent you an email confirmation of your purchase. To receive a full refund, you haven’t been using our chat services.
To exercise your right to cancel, you must notify us using the contact form, clearly indicating in the subject field your wish to cancel your subscription. It is absolutely necessary to provide your profile name, profile ID, and your service password on our site or app to validate your cancellation. Failure to provide this information will be considered a non-valid cancellation, as we require proof of your identity and intention.
In the case of premium memberships purchased through Apple via the iOS app or Google via the Android app, Apple/Google may also provide additional mechanisms for cancellation. To cancel your premium membership purchased from Apple via the iOS app or Google via the Android app, please follow their cancellation instructions.
If you cancel your subscription within the 14-day cancellation period, we will refund all payments we have received from you for the cancelled premium membership. Refunds will normally be provided using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise. Amount of Refund: If you have begun using the premium membership within the 14-day cancellation period, we will be entitled to retain from the refunded payment a reasonable amount (value compensation) for the portion of the premium membership that you have already used.

2. Identity Checks
Security and safety are of utmost importance to us. Therefore, we may request additional information to verify your identity in certain cases. This typically occurs after abuse reports from other users or when our automated security systems flag suspicious behavior.
3. Information
a. Confidentiality
By providing information to the Company, you understand that it will be accessible to anyone using our services and/or visiting our site.
You agree that any material or information you provide, including personal data, will be treated as non-confidential and non-proprietary. We may use such material or information without restriction, as long as the use complies with our Privacy Statement and applicable laws. Specifically, you consent to the Company using material or information (including profile information, photographs, video, or audio recordings) for copying your profile into other relevant dating sites owned and operated by the Company. You acknowledge that this material or information will be available for other members or users of the site(s) or app(s).
You agree not to use any information about third parties (including other members) that you receive through the Service for commercial or advertising purposes. The use of technological methods or processes to automatically download or access information about other members for use outside our platform is strictly prohibited. Usage of crawlers is also strictly prohibited.
You agree that any material or information you provide, including personal data, will be treated as non-confidential and non-proprietary. We may use such material or information without restriction, as long as the use complies with our Privacy Statement and applicable laws. Specifically, you consent to the Company using material or information (including profile information, photographs, video, or audio recordings) for copying your profile into other relevant dating sites owned and operated by the Company. You agree not to use any information about third parties (including other members) that you receive through the Service for commercial or advertising purposes. The use of technological methods or processes to automatically download or access information about other members for use outside our platform is strictly prohibited. Usage of crawlers is also strictly prohibited.
b. Accurate and Appropriate Information
You are responsible for the accuracy of the content you provide at registration and in your profile. By providing this information, you confirm that it is truthful and accurate. Intentional or fraudulent misrepresentation of your identity, including the use of another or fake identity, can subject you to legal liability.
You warrant and undertake that the information and media you supply are accurate, not in breach of this agreement, and not harmful in any way. You must not transmit or post on our website or platform any images containing nudity, cartoons, illegal information, hate speech, obscene or harmful content, severely manipulated photos, or photos of other persons.
Posting links to other websites or apps in your profile is prohibited, as well as any action showing other users how to contact you outside our provided services.
The Company reserves the right to delete, manipulate, or edit messages or material (including profiles, messages, links, videos, and audio recordings) that we deem, in our sole discretion, to breach our Terms of Use or to be otherwise unacceptable.
You warrant and undertake that the information and media you supply are accurate, not in breach of this agreement, and not harmful in any way. You must not transmit or post on our website or platform any images containing nudity, cartoons, illegal information, hate speech, obscene or harmful content, severely manipulated photos, or photos of other persons.
Posting links to other websites or apps in your profile is prohibited, as well as any action showing other users how to contact you outside our provided services.
The Company reserves the right to delete, manipulate, or edit messages or material (including profiles, messages, links, videos, and audio recordings) that we deem, in our sole discretion, to breach our Terms of Use or to be otherwise unacceptable.
c. Your Records, Cancellation, and Deletion of Your Data
You understand that all your data related to your current membership will be automatically deleted if your profile is inactive for more than twelve months.
You can switch off your account at any time in the Settings on our website. Premium members can make their profile invisible to other users while still being able to use our services.
You expressly consent to the transfer and storage of your personal data to our members, employees, and third parties, both in your country and abroad, fully understanding the risks associated with such transfers and storage, especially when these countries may not offer the same level of protection as your country of residence.
Immediate deletion of all your personal data can be requested by contacting support@pinaheart.com.

4. Behavior and Responsibility
Intentional or fraudulent misrepresentation of your identity, including the use of another or fictitious identity, can subject you to legal liability.
Information you receive from other members cannot be freely communicated to third parties without explicit consent from the member whose information you received.
The Company cannot be held responsible for preserving important information that you save in your profile or communicate to other members. You should make copies of important information and not rely on the Company to maintain your records or messages. While we intend to keep all your records intact during the time members are paying for services, we do not act as a safe haven or backup center for your data.
You are solely responsible for your interactions with other members of the Service.
You understand that we have the right (but not the obligation) to refuse to post, or to remove, any content that you make available on the service. We also have the right to change, condense, or delete such content at our sole discretion.
The Company strictly prohibits using our services to threaten or harass other members or to infringe any third-party rights (including personal rights).
Intercepting or attempting to intercept any emails/messages is strictly forbidden. Offering or promoting goods or services to other members is prohibited. Any message with the slightest commercial intent, including chain letters or communications with intent other than using our platform for dating, is not allowed.
The Company does not accept responsibility for any interference or damage to your computer system which arises in connection with your use of the service, the website, or any linked website.
We do not represent or warrant that the material or information provided through the service or on the website (including any member profile, advice, opinion, statement, or other information) is reliable, accurate, or that your access to the service or the website will be uninterrupted, speedy, or secure.
If you reside in the Philippines, or any jurisdiction that prohibits marriage-matching services to its residents, you warrant, represent, and covenant that you will not use our services or the website in breach of any legislation prohibiting marriage-matching. You acknowledge and agree that it is your sole responsibility to ensure compliance with any such prohibition.
If you do not comply with the conduct requirements or fail to materially comply with any other Terms, we may take actions including: issuing a warning, deleting submitted content in breach of our conduct requirements, suspending service provision (in whole or in part), or terminating service provision. If we terminate your subscription for misuse, we will refund any payment for unused portions of Premium Membership, less any reasonable compensation for net costs incurred due to non-compliance.
Information you receive from other members cannot be freely communicated to third parties without explicit consent from the member whose information you received.

Links to other websites or platforms found on our app or site should not be considered an endorsement, recommendation, or review by the Company of the linked sites or organizations. When following a link to another site or app, we urge you to read the Terms of Use of the linked organization.
